These are the terms between you and us, Affinity Search Partners, for this website. They are short on purpose, and they are written to you rather than about you. If anything here is unclear, ask us using the details at the end.
Opening this site means you accept these terms
These terms govern how you use this website. Reading it, browsing it or following its links counts as accepting them. If they are not acceptable to you, the right move is to close the page. Our privacy page is written to sit alongside this one; between the two of them, everything about this site is covered.
The site describes what we do, and nothing here is an offer
This website explains our recruiting and placement work and why you may have heard from us. It is information, not an offer, and reading it does not create an engagement between us. Any work we do for a client, and any obligation either side takes on, comes from a written agreement that both parties have signed. Where that written agreement and this website say different things, the written agreement wins.
We may email you at work, and you can stop it
Our recruiting work involves emailing people whose jobs connect to what we do: the people who hire technical staff, the people who lead technology teams, and technical people whose experience matches a role we are working on. If one of those emails reaches you and you would rather it were the last, replying in any words is enough and we will stop. Our privacy page explains how we handle your information and how our stop list keeps a request to stop working.
Samples are samples
A board, a chart, a checklist, a list of steps or a number may appear here, or in something we link to, as a sample. It is there to show how such a thing might look. It does not record any client's results, it does not describe a particular search, and nothing about it promises what a search for you would produce.
Use the site lawfully and leave it working
Lawful purposes are the only ones this site is for. You agree not to do anything that would disrupt it or the servers behind it; not to try to get into any area of it, or any system connected to it, that is not openly offered; not to probe or test it for weaknesses; and not to copy its content by automated means, whether by scraping, by crawling in order to collect it, or by any similar method.
The content belongs to us
The text, layout, logo and other material on this site belong to us or to the people who license it to us. You are welcome to read it, and to keep a printed or saved copy for reference within your own business. You may not republish it, sell it, or present it as your own. Rights in work we produce for a client come from the written agreement with that client, not from these terms.
Links lead to other people's terms
From here you can reach our main website and our company page on LinkedIn, and the Raleway typeface you are reading arrives from Google's font hosting. Each of those is run by someone else under their own terms and their own privacy practices, which we do not control. Following a link or loading the font means you are dealing with that party on its terms.
We provide the site as it is
You get this site "as is". You also get it "as available", with no promise that it will be up when you want it. As far as the law lets us, we disclaim every warranty about it, whether spoken, written or implied, and that includes the implied warranties that the site is merchantable, suits a particular purpose, or infringes nobody's rights. We make no promise of an error-free or uninterrupted site, and no promise that anything on it is current or complete.
Nothing on this site is professional advice. It is not legal advice, not financial advice and not employment advice, and acting on it as though it were would be a mistake. Our liability is limited
As far as the law permits, we carry no liability to you for any damage that counts as indirect or incidental, or as special, consequential or punitive, whether they come from using this site or from being unable to, and we are not liable for profits, revenue, data or opportunities you lose, however the loss arises and whatever legal theory is applied. Everything connected with this site together carries a ceiling on our liability to you of one hundred US dollars. Where a jurisdiction refuses to honour a limit of this kind, the limit applies only as far as that jurisdiction permits.
Misuse of the site is on you
Should you misuse this site, or break these terms, and a claim, loss or expense results, you agree to indemnify us and hold us harmless from it. That includes reasonable attorneys' fees. We will tell you promptly about any such claim and will not settle it in a way that binds you without your agreement.
Tennessee law applies, and disputes go to arbitration
The State of Tennessee supplies the law that governs these terms, with its rules on conflict of laws set aside. Should a dispute arise out of these terms or out of the way you use the site, it goes to binding arbitration. The seat is Williamson County, Tennessee, and the American Arbitration Association's rules apply. The arbitrator's award is final, and any court with the authority to do so may enter it as a judgment. If a particular claim cannot lawfully be arbitrated, the state or federal courts sitting in Williamson County, Tennessee hear it instead, and you consent to those courts.
A few general points
Should a court find one clause of these terms unenforceable, the others stand, and the unenforceable clause is read as narrowly as needed to make it enforceable. Letting a breach pass once does not waive our right to act on the next. Together with the privacy page, these terms are the complete understanding between you and us on the subject of this website, and they replace anything earlier on that subject. We may update them; when we do, the date beneath the heading changes, and whichever version is on the site when you use it is the one that applies.
